Términos de Servicio

Al acceder o utilizar 10Quant (la «Plataforma»), usted acepta quedar vinculado por estos Términos de Servicio (los «Términos»). Si no está de acuerdo con estos Términos, no podrá acceder ni utilizar la Plataforma.

Estos Términos constituyen un acuerdo legalmente vinculante entre usted y 10Quant. Nos reservamos el derecho de actualizar estos Términos en cualquier momento, y su uso continuado de la Plataforma constituye la aceptación de dichos cambios.

10Quant proporciona una plataforma automatizada de pair trading para los mercados de criptomonedas. Nuestros servicios incluyen ejecución automatizada de operaciones, supervisión de rendimiento, herramientas de gestión de riesgos y paneles analíticos.

Nuestra Plataforma se conecta a los exchanges de criptomonedas compatibles mediante las claves API que usted proporciona. Todas las operaciones se ejecutan en su cuenta del exchange. 10Quant nunca toma custodia de sus fondos.

Debe registrar una cuenta para utilizar nuestros servicios. Usted es responsable de mantener la confidencialidad de las credenciales de su cuenta y de todas las actividades que se realicen en ella.

Debe proporcionar información precisa y completa durante el registro. Es obligatorio actualizar su información de forma puntual si se producen cambios.

Debe tener al menos 18 años de edad y estar legalmente autorizado para utilizar servicios de trading de criptomonedas en su jurisdicción.

You agree not to engage in any of the following prohibited activities: market manipulation, spoofing, wash trading, or any practice that could distort market prices or disadvantage other market participants.

You may not reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Platform, its algorithms, or its underlying technology.

You may not use automated tools (bots, scrapers, spiders) to access the Platform for purposes other than those expressly permitted, or attempt to gain unauthorized access to any part of the Platform or its related systems.

You may not abuse the Platform's infrastructure, including excessive API calls, bandwidth consumption, or any activity that could degrade performance for other users.

You are solely responsible for the security of your API keys. You must use trade-only API key permissions and must not share your API keys with any third party. You acknowledge that any unauthorized use of your API keys is your responsibility.

Nuestras estrategias de trading automatizado se proporcionan con fines informativos y de ejecución. El rendimiento pasado no garantiza resultados futuros. El trading implica un riesgo significativo de pérdida.

Usted reconoce que todas las decisiones de trading, incluido el uso de estrategias automatizadas, se asumen bajo su propia responsabilidad. Usted conserva el control total sobre su cuenta del exchange y puede pausar o detener las estrategias en cualquier momento.

10Quant actúa como proveedor de herramientas y no ofrece asesoramiento financiero personalizado, recomendaciones de inversión ni servicios de gestión de cartera.

El trading de criptomonedas conlleva un riesgo sustancial, incluida la posible pérdida de su inversión total. Las condiciones del mercado, los fallos técnicos y los cambios regulatorios pueden derivar en pérdidas financieras significativas.

Usted reconoce haber leído y comprendido nuestro Documento de Divulgación de Riesgos y acepta los riesgos asociados al uso de sistemas de trading automatizado.

THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

10Quant does not warrant that the Platform will be uninterrupted, timely, secure, or error-free. We do not guarantee the accuracy, completeness, or reliability of any trading data, analytics, or performance metrics displayed on the Platform.

You acknowledge that the Platform relies on third-party exchange APIs, network infrastructure, and market data feeds. 10Quant is not responsible for any losses resulting from exchange outages, API failures, data feed errors, or any other third-party service disruptions.

En la máxima medida permitida por la ley, 10Quant no será responsable de ningún daño directo, indirecto, incidental, especial o consecuente derivado del uso de la Plataforma, incluyendo, entre otros, pérdidas de trading, interrupciones del sistema o brechas de seguridad.

Nuestra responsabilidad total para con usted no excederá el total de las tarifas abonadas a 10Quant en los 12 meses anteriores a la reclamación.

You agree to indemnify, defend, and hold harmless 10Quant, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Platform, your violation of these Terms, or your violation of any rights of another party.

This indemnification obligation will survive the termination of your account and these Terms.

Las tarifas de suscripción se facturan por adelantado según el plan seleccionado (mensual o anual). Todos los pagos se procesan a través de nuestros socios de pago autorizados.

Aceptamos pagos con criptomonedas, incluyendo BTC, ETH, USDT y USDC. Los precios se indican en USD y se convierten al tipo de cambio vigente en el momento del pago.

Los reembolsos están sujetos a nuestra garantía de devolución de 30 días para nuevos suscriptores. Transcurrido el periodo de garantía, el tiempo de suscripción no utilizado no es reembolsable.

Todo el contenido, software, algoritmos y materiales de la Plataforma son propiedad de 10Quant y están protegidos por las leyes de propiedad intelectual. Usted no puede copiar, modificar, distribuir ni realizar ingeniería inversa de ninguna parte de la Plataforma.

10Quant le otorga una licencia limitada, no exclusiva e intransferible para utilizar la Plataforma con fines de trading personal y no comercial durante su suscripción activa.

10Quant shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to: natural disasters, wars, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

This also includes exchange outages, API deprecations or failures, regulatory changes or government actions affecting cryptocurrency trading, network attacks (DDoS, hacking), blockchain forks or consensus failures, and pandemic or epidemic events.

If a force majeure event continues for more than 60 consecutive days, either party may terminate these Terms upon written notice.

Cualquiera de las partes puede terminar este acuerdo en cualquier momento. Puede cancelar su suscripción desde la configuración de su cuenta. Tras la terminación, su acceso a la Plataforma cesará al final del periodo de facturación vigente.

Nos reservamos el derecho de suspender o terminar cuentas que infrinjan estos Términos, participen en actividades fraudulentas o supongan un riesgo para la Plataforma o para otros usuarios.

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be determined by binding arbitration administered by a mutually agreed upon arbitration institution. The arbitration shall be conducted in English. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against 10Quant.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which 10Quant is organized, without regard to its conflict of law provisions.

Exception: Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Entire Agreement: These Terms, together with our Privacy Policy and Risk Disclosure, constitute the entire agreement between you and 10Quant and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Platform.

Podemos actualizar estos Términos de vez en cuando. Los cambios significativos se comunicarán por correo electrónico o mediante una notificación en la Plataforma con al menos 30 días de antelación a su entrada en vigor. Su uso continuado tras la entrada en vigor de los cambios constituye la aceptación de los Términos revisados.
